The apparent vices are those housing problems that are found with the naked eye, that is, those that you can discover for yourself. Hidden vices are those problems in the house that are not visible to the naked eye and that therefore you were unaware of when you purchased the house. Those defects or damages that make the house unfit to live in or that diminish its usefulness, in such a way that if you had known about them you would not have bought the property or you would have offered less for it.

Who is responsible for answering for hidden defects
The responsibility for hidden defects rests with the seller, regardless of whether he was aware of them or not. This is because one of the seller’s obligations is to deliver a house in the absence of these problems and, likewise, you as a buyer have the right to receive a home that does not have such damages. This is why with the mere fact of presenting them, the responsibility falls on the seller and he himself must answer for them.
How to claim for hidden defects
You can only claim for hidden defects the first year after the delivery of the house. To make the seller responsible for hidden defects, you must prove that these existed before or at the time of the sale of the property. Otherwise, it would be assumed that the damage occurred after acquiring your home, so the responsibility would be yours. Once proving this, the seller will be forced to repair the flaws of the property at no cost. In case the defects are irreparable, you have two options:
• Request that your property be replaced
• Request that the money you paid for the house be returned, in addition to the corresponding interest.
Vices in a new house
If the house you bought is new, the claim is different. In this case, those responsible for the correction of the vices would be those in charge of the construction and, as it is a house with new facilities that has not yet been inhabited, you can report them for both hidden and apparent vices. The Federal Consumer Protection Law establishes that from the moment you acquire the property you have five years to complain about any problem related to the structure and three years for aspects that have to do with waterproofing. In the case of apparent vices, you only have one year to report them. If your complaint is made within the established deadlines, the supplier will be obliged to repair the construction faults at no cost.
